Ranking New England States Based on Their ADU Laws

Updated: Dec 15, 2025

Let's rank the New England states. We all have ADU laws. It's a strong showing for our region, but they're not all created equal. And let me say, New England, I love each of you. We're an amazing region, and we're all Red Sox fans here.

4 Now, Connecticut, I'm sorry to rag on you, but I gotta put you at the bottom. You pass an ADU law with some good leadership, but you let every municipality decide if they're gonna opt in or out? What's the point?

3 Next up, Rhode Island, again, some strong leadership here. You passed some laws early, but for a detached ADU, you need to have a 20,000 square foot lot minimum. That's like the size of your entire state.

2 Next up, Maine, Vermont, New Hampshire, tied for second place. You all require owner occupancy, but you have some strong protections and you generally allow ADUs, so good showing. Good start. There's some room for improvement.

1 Top spot right now, Massachusetts. With the Affordable Homes Act, every single family residential property, in Massachusetts qualifies for an ADU outside of Boston and owner occupancy is not required. This is a good leadership position. The rest of New England, catch up.
